Who needs a Will?
Everyone needs a Will, no matter how old, especially if you have children.
I don’t really have anything to pass on, do I still need a Will?
Yes! You may not own a house, but you do have possessions and funeral requests. And whatever money you have – no matter how little – has to go somewhere.
Doesn’t it all pass on automatically?
No! Without a Will, you have no legal say in where your assets go. Even if you’ve been with your partner for 30 years, they won’t automatically inherit everything if you’re not married. Even if you are married, other family members can make a claim, whether you want them to or not.
Surely my children will inherit everything anyway?
Not necessarily. If you remarry again without making a Will, your new spouse will inherit everything before your children, and there is absolutely no legal requirement for them to give your kids a penny of your money.
Is making a Will expensive?
Surprisingly not. Because legal documents are involved, many people assume that creating a Will is costly, but not at all. Every client’s needs are different, and the cost of a Will depends on the complexity of those needs and the amount of work required to draft them into an agreed and valid document. Can't I make my own Will?
You can, but you can also perform your own dentistry but that doesn't necessarily make it a good idea. Wills, trusts and probate is a complicated area of law, and the services of an expert specialising in this field are important in ensuring that a will accurately reflects your wishes. DIY wills often limit the powers of the executor, which can lead to problems in the future.
Do I need to update my Will?
If you have already made a Will it is important that it is kept up to date to reflect your circumstances. You should review your Will whenever your circumstances change in any significant way, such as marriage, divorce, having children, or buying any large asset. We recommend having a good look at your Will every five years to make sure it's still suitable for your needs.
